Lawmakers propose raising online betting consumption tax to 5% in Peru

Peruvian lawmakers have introduced a bill to raise the Selective Consumption Tax on online gaming and sports betting from 1% to 5%, citing gambling addiction prevention.

The bill, presented by deputies from Partido Cívico Obras at the prompting of Luis Aurelio Masco Cáceres, would apply the higher rate to the value of each wager, defined as money or a money-valued bonus. Domestic and foreign platforms would face the same nominal ISC rate.

The explanatory memorandum distinguishes the ISC from the separate 12% tax under Law 31557, whose rate and calculation rules would remain unchanged. Land-based casinos, slot halls and physical betting establishments would not be affected. It cites Ministry of Health figures of 14,409 healthcare attendances for gambling addiction in 2025.

The proposal does not create treatment programmes or earmark revenue. It says operators could absorb the higher tax, pass it to players or share the cost, and flags risks including betting-activity changes. If enacted, the law would take effect the day after publication, with the 5% rate applying from the following month.
