New Jersey brings in new safeguards for online gamblers

New Jersey has made data-driven responsible gaming requirements mandatory under state regulations, requiring operators to identify at-risk patrons and provide phased interventions.

New Jersey has codified data-driven responsible gambling requirements into state regulations, making them mandatory and, according to Attorney General Jennifer Davenport and the Division of Gaming Enforcement, the first such enforceable statewide standard. Governor Mikie Sherrill said the rules aim to make online gaming and sports wagering safer.

Operators must appoint a responsible gaming lead, use mandatory patron-play thresholds and behavioral triggers, conduct due diligence reviews when criteria are met, place at-risk patrons on a list and apply three phases of intervention. Officials said operators already had responsible gaming staff and similar practices, but no uniform regulatorily enforceable standard for review and phased help.

The state also said it is asking the US Supreme Court to hear its case against prediction market Kalshi, with amicus support from a bipartisan coalition of 39 states and DC, 146 Indian tribes and tribal organizations, the NFL and industry groups. Separately, Davenport and DGE announced free access to the RecoverMe CBT and mindfulness app for New Jersey residents and patrons.
