Peru opens consultation on changes to online gambling and sports betting regulations

Peru’s MINCETUR has opened a 15-day public consultation on draft amendments to online gambling and sports betting rules, with submissions due by 5 November 2026.

Peru’s Ministry of Foreign Trade and Tourism (MINCETUR) has opened a 15-day public consultation on proposed changes to online gambling and sports betting regulations. The consultation was announced in Ministerial Resolution No. 382-2026-MINCETUR, published in El Peruano on 21 October, and runs from 22 October to 5 November 2026.

The draft supreme decree would amend regulations implementing Law No. 31557, approved through Supreme Decree No. 005-2023-MINCETUR. It covers operator obligations and prohibitions, supervision and enforcement, operational-data transmission, audits, guarantees, confiscation procedures and criteria for fines. MINCETUR said the changes aim to improve clarity, predictability and effectiveness, drawing on experience since the framework took effect. The draft would also clarify requirements for remote gaming and sports betting operators and land-based sports betting rooms, and strengthen oversight. Proposed fine criteria include illicit benefit, detection probability, harm, intent, market and consumer impact, repeat offending and financial capacity. The DGJCMT will assess submissions.

Separately, Legislative Proposal No. 00519-2026-2031-CD, filed on 6 October and in committee, would raise the Selective Consumption Tax on remote gaming and sports betting from 1% to 5% of each wager. The 12% tax under Law No. 31557 would remain unchanged.
